TERMS OF SERVICE (TOS)

1. INTRODUCTION
These Terms of Service ("Terms") govern your access to and use of SurveyHeart, operated by SurveyHeart LLP ("SurveyHeart", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must stop using the platform.
2. DEFINITIONS
- "User" - any person who creates an account on SurveyHeart.
- "Form Creator / Customer" - the User who designs forms, surveys, templates, quizzes, or collects responses.
- "Responder / Data Principal" - any person who fills or submits a form created by a User.
- "Data Fiduciary / Controller" - the User responsible for determining the purpose of data collection.
- "Processor / Service Provider" - SurveyHeart, processing data solely under User instructions.
- "Services" - all features offered by SurveyHeart including forms, surveys, workflows, templates, analytics, sector packs, APIs, and add-ons.
3. Eligibility & Account Requirements
You must be at least 18 years old to create a SurveyHeart account (to be a Form Creator). Responders may be younger than 18 where the Form Creator has obtained the parental or guardian consent required by applicable law. You agree to provide accurate information and maintain the confidentiality of your account credentials. You are responsible for all activities under your account.
4. Description of Services
SurveyHeart provides tools to create, distribute, and analyze forms, surveys, quizzes, templates, workflows, and related digital content. We also offer paid subscriptions, add-ons, sector packs, and APIs.
5. Data Protection & Privacy
Your use of SurveyHeart is governed by the SurveyHeart Global Data Privacy Policy as published on our website. By using the platform, you consent to our data practices including processing and storage in India.
Roles:
- Form Creators are Data Controllers/Fiduciaries.
- SurveyHeart is a Data Processor/Service Provider.
Form Creators must obtain consent from Responders as required by applicable law.
6. User-Generated Content (UGC)
Users retain ownership of content they create. By using our service, you grant SurveyHeart a limited, non-exclusive license to store and process the content solely to operate the platform.
Users must not upload content that is illegal, harmful, abusive, defamatory, hateful, infringing, or violates privacy rights.
SurveyHeart may remove content or suspend accounts for violations.
7. Unlimited Responses Policy Update
SurveyHeart is updating how unlimited form responses are provided across all plans. Beginning December 15, 2025, all free and paid plans will include unlimited form responses with a non-intrusive advertisement displayed on the Thank-You page after a respondent completes a form. This advertisement does not interfere with the form content or the submission process.
Users who subscribed to any paid plan before December 15, 2025 will continue to receive unlimited responses without advertisements until April 1, 2026. After this date, the updated policy will automatically apply to all such accounts.
Users may choose to apply the updated policy earlier by selecting "Accept Changes" in the in-app notice presented on SurveyHeart Web, Android, or iOS. Users who choose "I have read & understood" or who do not respond will continue with their current ad-free experience until April 1, 2026.
By continuing to use SurveyHeart after April 1, 2026, all users agree to the updated unlimited responses policy.
8. Subscriptions, Billing & Refunds
SurveyHeart offers free and paid subscription plans. Paid plans auto-renew unless cancelled.
- Billing occurs in advance.
- Taxes may apply.
- Refunds are not issued for partial periods, add-ons, or unused time.
- Cancelling stops the next billing cycle but does not refund the current cycle.
9. Acceptable Use Policy
You agree NOT to:
- Use the service for spam or unsolicited communication.
- Collect sensitive personal data without consent.
- Attempt to hack, reverse-engineer, misuse APIs, or disrupt the service.
- Upload malware or harmful scripts.
- Violate any applicable laws.
10. API Terms
SurveyHeart may offer APIs for automation and integration. By using APIs, you agree to:
- Respect rate limits.
- Not use APIs for scraping or abusive purposes.
- Secure your API keys.
SurveyHeart may revoke API access at any time for misuse.
11. Intellectual Property
SurveyHeart retains all rights to its platform, interface, algorithms, templates, branding, and design. Users retain rights to the forms and data they create.
12. Service Availability & Disclaimer
We aim for 99.5% uptime but do not guarantee uninterrupted service. Maintenance, updates, outages, or unforeseen events may impact availability.
Services are provided "as is" without warranties of any kind.
13. Limitation of Liability
To the maximum extent permitted by law, SurveyHeart shall not be liable for:
- Loss of data
- Loss of profits
- Indirect, incidental, or consequential damages
Our total liability shall not exceed the amount paid by the User in the past 12 months.
14. Indemnity
Users agree to indemnify and hold SurveyHeart harmless from claims arising from:
- Illegal or harmful content uploaded
- Violation of data protection laws
- Misuse of SurveyHeart services
- Disputes with Responders
15. Termination & Suspension
Users may delete their account at any time. SurveyHeart may suspend or terminate accounts that violate these Terms, cause risk, or misuse the service.
16. Governing Law, Jurisdiction & Arbitration
These Terms are governed by the laws of India.
Disputes shall be resolved exclusively in Hyderabad, Telangana.
All disputes shall be settled through binding arbitration under the Arbitration & Conciliation Act, 1996. The seat and venue of arbitration shall be Hyderabad.
17. Modifications to Terms
We may update these Terms. Material changes will be communicated through email or platform notifications. Continued use constitutes acceptance.
